What is IR1 Visa?

IR1 Visa is a Marriage-Based Immigrant Visa that allows the spouse of a U.S. citizen or permanent resident to live and work anywhere in the United States. The spouse will have permanent resident status until he/she decides to apply for U.S. citizenship, for which he/she becomes eligible after three years.


Who is considered as “Spouse”?

A spouse is a legally wedded husband and wife.

  • Merely living together does not qualify a marriage for immigration.

  • Common-law spouses may qualify as spouses for immigration purposes depending on the laws of the country where the common-law marriage occurs.

  • In the case of polygamy, only the first spouse may qualify as a spouse for immigration.

  • Same-sex spouses of U.S. Citizens and Lawful Permanent Residents, along with their minor children, are now eligible for the same immigration benefits as opposite-sex spouses.


What is a Conditional Green Card?

A conditional Green Card is a temporary, 2-year Green Card issued to recently married immigrants. If a foreigner has been married to a U.S. citizen spouse for less than two years when he/she either arrive in the United States on an immigrant visa or are approved for a green card via adjustment of status, he/she will receive a Conditional Green Card. Additionally, in order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status.


What is the IR1 Visa Processing Time?

Generally, the USCIS will take 14.5 Months to 18.5 Months to process your application. This time range is how long it is taking USCIS to process your case from the date they received it.


What are the filing fees for IR1 Visa?

  • Form I-130 filing fees: $535

  • Form I-485 filing fees (for Adjustment of Status): $ 1,225 (including $1,140 for the green card application and $85 for biometrics)

  • NVC filing fees (for Consular Process): $445 (including $120 for the financial support form and $325 for the State Department processing fee)

  • Green Card fees: $220 (must be paid online before a physical Green Card can be issued)

  • Translation fees: Approximately $500-$800

  • Medical Exam: Approximately $450-$800
